You may terminate this Agreement at any time, provided that you discontinue any further use of this Site. eHoton also may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, if in eHoton’s sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of the Agreement by either you or eHoton, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the Terms of Use or otherwise. eHoton’s right to any Comments shall survive any termination of this Agreement.

Limitation of Liability

Order Acceptance
Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order.
Pricing Information
While eHoton strives to provide accurate product and pricing information, pricing or typographical errors may occur. eHoton cannot confirm the price of an item until after you order. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, eHoton shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. In the event that an item is mis-priced, eHoton may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation.
Force Majeure
The Sellers shall not be held responsible for the delay in shipment or non-delivery of the goods due to war, earthquake, serious flood, fire and other Force majeure causes agreed by both parties. However, the Sellers shall advise the Buyers by fax/telex, immediately of such occurrence and within fourteen days thereafter, shall send by airmail to the Buyers for their acceptance a certificate issued by the competent authorities of the place where the accident occurs as evidence thereof. Under such circumstances the Sellers, however, are still under the obligation to take all necessary measures to hasten the delivery of the goods. In case the late delivery exceeds ten weeks, the Buyers shall have the right to cancel this Contract.
Arbitration
where the parties fail to settle dispute within 30 days after such dispute occurs, they agree to submit such dispute to China International Economic and Trade Arbitration Commission for arbitration which shall be conducted in accordance with the Commission's arbitration rules in effect at the time of applying for arbitration. The arbitral awards are final and binding upon both parties.
General
This Agreement represents the complete agreement between the parties and supersedes all prior agreements and representations between them. Headings used in these Terms of Use are for reference purposes only and in no way define or limit the scope of the section. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and the other terms of this Agreement shall remain in full force and effect. The failure of eHoton to act with respect to a breach of this Agreement by you or others does not constitute a waiver and shall not limit eHoton’s rights with respect to such breach or any subsequent breaches. This Agreement shall be governed by and construed under law without regard to conflicts of law provisions.
Return and Exchange policy
HOW TO RETURN AN ITEM: If for any reason you are not completely satisfied with your purchase you may return your merchandise for STORE CREDIT LESS SHIPPING FEES AND APPROPRIATE RESTOCKING FEES. Store credit may be used for any future purchases on our website for merchandise of any kind but store credit cannot be used towards shipping costs. We sell seasonal, time sensitive items so you must contact us within 5 days of receiving your order for a return authorization number. Merchandise must be postmarked within 5 days of receiving a return authorization number from us. Merchandise returned without authorization or returned late will be refused. All original tags must be in place to receive credit for the return. All merchandise is carefully inspected before accepted by our return department. Any items returned to us without original tags in place, that appear to have been worn, or are not sent back in the condition it was sent will not receive credit in any form. Customer is responsible for return shipping fees via their carrier of choice, provided they receive a valid tracking number for proof of return.
HOW TO EXCHANGE AN ITEM: If you need to exchange an item for any reason you must return the original item to us per our return policy above. Once the returned item is received it will be inspected and you will be issued the appropriate store credit in accordance with our return policy. Once you receive your store credit code you will need to place a new order. At checkout, enter the store credit code and press the “Use Gift Certificate” button to apply the credit. If you are concerned about your event date being too close for an exchanged item, please contact us for assistance in expediting your return.
NON-RETURNABLE / NON-REFUNDABLE ITEMS: Sale items, Final Sale/No Returns items, stay up tape, lingerie, cosmetics, and visors cannot be returned, exchanged or cancelled.
PLEASE NOTE: Any returns or exchanges postmarked after 5 days of your receipt date and/or missing a return authorization number will be returned to you at your shipping expense. The goods must be returned in original condition. We have 100% inspection on merchandise leaving the warehouse to ensure our merchandise is sent free of defects. All returns are inspected upon receipt. Items must not have been worn, washed, altered and must have all originals tags attached and in original packaging. If you do not accept the item being returned to you, you will not receive credit of any kind.
RESTOCKING FEES: There is a 10% restocking fee per item for all returns and/or exchanges.
STORE CREDIT: Store credit is valid for one year after issue date.
RETURN AUTHORIZATION REQUEST: To receive your return authorization number please go to www.promgirl.com/returns and fill out the return authorization request form. Make sure you have added PromGirl.com and Simplydresses.com to your email safe list to insure receiving our email with your return authorization number. Please put Return Authorization number issued on the outside of the box.
